If you become disabled and are not sure what benefits you may be entitled to under the Social Security Law, the safest bet is to file your application for Social Security benefits.
The earlier you file the better. However, you should know that unless your disability has lasted or is expected to last at least one year you will not be approved. Nonetheless, filing early is important because most claims are denied on the original application.
When a claim is denied, an appeal can be taken. Unfortunately, the appeal process takes between eight months and one year before a decision is rendered. If successful, past due benefits could be awarded.
Because of the lengthy appeal process it is recommended that someone who realistically anticipates being disabled for at least a year should file for benefits as soon as possible.
